Please read these terms before using Nestor. By using our website or submitting a care request, you agree to them. If you do not agree, please do not use the service.

1. About us and these terms

Nestor is a trading name of Nextmoov Ltd, a company registered in England and Wales, with its registered office at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom ("Nestor", "we", "us"). These terms cover find.nestor.org.uk, www.nestor.org.uk and the care home search service offered through them ("the Service"). Our Privacy policy and Cookie policy form part of these terms.

2. What Nestor does

Nestor helps families in the UK find a care home that has a place available. When you submit a request, we and our partner advisers:

• check which homes in our partner network near the area you chose have a place, and for which type of care;
• check their weekly fees and their latest regulator rating (CQC in England, or the equivalent body in Scotland, Wales and Northern Ireland);
• send you a list of suitable homes and, if you wish, put you in touch with them so you can ask questions and arrange a visit.

Figures such as "places near you" on our pages are updated regularly from our partner network and are given as a guide to what is available in the area at the time shown. They are not a reservation and can change at any time.

3. Free for families, paid by care homes

The Service is free for you. You will never be asked to pay Nestor, and there is no obligation to choose any home we suggest. Nestor and its partner advisers are paid by care homes in our partner network when a resident moves in following an introduction. This does not change the fees you pay the home, and homes are selected on availability, type of care, location and rating, not on what they pay us. Our network does not include every care home in the UK, so there may be suitable homes we do not suggest.

4. What Nestor is not

• Nestor is not a care provider, a care home, a local authority or an NHS service. We do not provide, arrange or supervise care.
• Nestor is not a party to any contract you sign with a care home. The home is responsible for the care it provides, its fees and its contract terms. Please read the home's contract carefully before signing.
• Information on our site, in our messages and from our advisers is general information to help you search. It is not medical, legal, financial or care advice. For an assessment of care needs or funding, contact your local authority or the NHS; for legal or financial advice, speak to a qualified professional.
• If someone is in immediate danger or needs urgent medical help, call 999. Our Service is not for emergencies.

5. Your side of the agreement

When you use the Service you agree to:

• be at least 18 years old;
• give accurate information and keep it up to date, and only give us details about another person if you are entitled to do so and they agree;
• use the Service for a genuine care search for yourself, a relative or someone you are helping, and not for marketing, recruitment, research or any commercial purpose without our written agreement;
• not copy, scrape, reverse-engineer or interfere with the website, its data or its security, and not submit false, abusive or unlawful content.

We may suspend or refuse the Service to anyone who breaks these terms.

6. Care homes, availability and fees

We take care to keep availability, fees and ratings accurate, but this information comes from care homes and public registers and can change daily. A place shown as available may have been taken, and fees shown are typical weekly fees that the home will confirm after assessing the person's needs. We cannot guarantee that a particular home will have a place, accept a resident or agree a fee. Always confirm details directly with the home before making a decision, and check the home's latest inspection report on the regulator's website.

7. Verification and contact

To make sure we only work on real requests, we text a one-time code to the mobile number you give us. By submitting a request you agree to receive this text and to be contacted by us or our partner advisers by phone, text message or email about your search. You can ask us to stop at any time by replying to a message or emailing hello@nestor.org.uk. Standard network charges may apply to text messages.

8. Our content

The Nestor name, logo, website design, text, images and data are owned by or licensed to Nextmoov Ltd and protected by copyright and trade mark law. You may view the site and print or save pages for your own personal use in choosing care. You may not reproduce, publish, distribute or commercially exploit any part of it without our written permission.

9. Links to other sites

Our site may link to care homes' websites, regulators and other third parties. We do not control those sites and are not responsible for their content or their handling of your data. Links are provided for your convenience only.

10. Our responsibility to you

We provide the Service with reasonable care and skill. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that, we are not responsible for:

• the care, services, fees, conduct or contract terms of any care home, or any loss arising from your dealings with a care home;
• decisions you make based on information from the Service, where you have not confirmed it with the home;
• the website being unavailable, interrupted or changed, or any loss of data outside our control;
• business losses, since the Service is intended for private, family use.

If we are liable to you for any reason, our total liability for all claims connected with the Service is limited to £1,000, reflecting the fact that the Service is free to you. Your statutory rights as a consumer are not affected.

11. Changes and ending the service

We may change the website or the Service, or stop offering it, at any time. We may update these terms; the date at the top shows the latest version, and changes apply from the time they are posted. If you continue to use the Service after a change, you accept the new terms. You can stop using the Service at any time and ask us to delete your request.

12. Law, complaints and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and you keep the protection of the consumer laws of the country where you live.

If something has gone wrong, please contact us first at hello@nestor.org.uk. We aim to respond within 5 working days and to resolve complaints within 28 days. Complaints about a care home should be made to the home and, if needed, to the regulator (CQC in England) or the Local Government and Social Care Ombudsman.

If any part of these terms is found invalid, the rest continues to apply. Only you and Nextmoov Ltd have rights under these terms.
